"The investigating officer on the case will only take Mr Mpofu's statement today, because he was sedated, " said Brigadier Marinda Mills.
"He is in a stable condition and is in a normal ward at a hospital I cannot name," she said.
On Thursday police cofirmed that two people attacked the former SABC chief executive while he was walking on a beach known as a crime hot spot in East London on Thursday.
Mpofu is representing the miners involved in last year's police shootings in Marikana, North West.
He was believed to be on a short break before the Farlam Commission of Inquiry into the Marikana shootings resumed next week.
Meanwhile, The Buffalo City metro expressed shock at the incident. "The City is deeply shocked by the unfortunate incident that has befallen advocate Dali Mpofu," spokesman Keith Ngesi said in a statement.
"We wish Mr Mpofu a speedy recovery and hope that the police will move swiftly with their investigation."
